This depends on the type of tenancy agreement you and the home you’re swapping with has.
If your tenancy agreement is dated after 1 April 2012:
- You’ll take over the tenancy agreement the home you’re swapping with has.
If your tenancy agreement is dated before 1 April 2012 and you’ve got an assured/lifetime tenancy:
- You’ll still be entitled to the same type of agreement, as long as your new home is under a social rent.
- This is the first time you’ve swapped your home via mutual exchange.
If your tenancy agreement is dated before 1 April 2012 and you’ve got a fixed term tenancy agreement:
- You’ll take over the tenancy agreement the home you’re swapping with has.
