This depends on the type of tenancy agreement you and the home youโre swapping with has.
If your tenancy agreement is dated after 1 April 2012:
- Youโll take over the tenancy agreement the home youโre swapping with has.
If your tenancy agreement is dated before 1 April 2012 and youโve got an assured/lifetime tenancy:
- Youโll still be entitled to the same type of agreement, as long as your new home is under a social rent.
- This is the first time youโve swapped your home via mutual exchange.
If your tenancy agreement is dated before 1 April 2012 and youโve got a fixed term tenancy agreement:
- Youโll take over the tenancy agreement the home youโre swapping with has.
If your agreement is changing, make sure youโre happy with it before swapping. Learn more about the different types of tenancy agreement here.
